Welcome to Clearly Education (“Clearly”, “we”, “our”, or “us”).

By accessing or using the Clearly Education website, services, applications, AI tools, memberships, or content (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Services.

1. Eligibility

You must be at least 18 years of age to create an account or purchase a subscription.

By using Clearly Education, you confirm that you are legally able to enter into this agreement.

2. Membership Accounts

To access certain features, you may be required to create an account.

You agree to:

Provide accurate and complete registration information.
Keep your account details up to date.
Maintain the confidentiality of your login credentials.
Accept responsibility for all activities that occur under your account.

You are responsible for safeguarding your password and restricting access to your account.

3. Subscription Plans and Billing

Clearly Education offers subscription-based membership plans.

By purchasing a subscription, you agree that:

Subscription fees are billed in advance.
Monthly subscriptions renew automatically every month unless cancelled.
Annual subscriptions renew automatically every year unless cancelled.
Founder plans and special promotional offers may be subject to separate terms.

All payments are processed securely through third-party payment providers, including Stripe.

You authorize Clearly Education to charge the applicable subscription fees to your selected payment method.

Prices may change from time to time. Any price changes will apply only to future billing periods.

4. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us.

Cancellation:

Stops future billing.
Does not provide a refund for the current billing period.
Allows continued access until the end of the current paid subscription period.

No partial refunds or credits are provided for unused subscription periods.

5. Credit Usage

Certain membership plans include usage credits.

Credits:

Are provided according to your membership plan.
Are consumed when AI tools are used.
Have no monetary value.
Cannot be transferred, sold, exchanged, or redeemed for cash.

Clearly Education reserves the right to modify credit allocations, limits, or usage policies at any time.

Any misuse, automated abuse, or attempts to circumvent usage limits may result in suspension or termination of access.

6. Acceptable Use

You agree not to:

Use the Services for unlawful purposes.
Share account access with unauthorized users.
Attempt to reverse engineer, copy, scrape, or reproduce the platform.
Interfere with or disrupt platform operation.
Use automated systems, bots, or scripts to abuse usage limits.
Upload or generate harmful, unlawful, defamatory, or inappropriate content.

Clearly Education reserves the right to remove content or restrict access where misuse is suspected.

7. Educational Content Disclaimer

Clearly Education provides AI-generated educational suggestions and support.

Users acknowledge that:

AI-generated content may contain inaccuracies.
All generated materials must be reviewed and adapted before use.
Users remain solely responsible for determining the suitability, accuracy, safety, and curriculum alignment of all generated content.

Clearly Education does not guarantee:

Educational outcomes.
Curriculum compliance.
Learner achievement or performance.
Accuracy or completeness of generated content.

8. Intellectual Property

All platform content, branding, software, designs, graphics, and materials are owned by Clearly Education unless otherwise stated.

Users are granted a limited, non-exclusive, non-transferable licence to use generated outputs for their own educational and professional purposes.

Users may not copy, reverse engineer, reproduce, resell, or create derivative products based on the Clearly platform, prompts, workflows, tool structures, or proprietary methods.

You may not:

Resell the platform.
Reproduce platform materials for commercial redistribution.
Copy, modify, or distribute proprietary platform content without permission.

9. Termination

Clearly Education may suspend or terminate accounts at any time if:

These Terms are violated.
Fraudulent activity is suspected.
Payment obligations are not met.
Platform abuse occurs.

Upon termination:

Access to the Services may cease immediately.
Unused credits may be forfeited.
No refund will be provided except where required by law.

10. Limitation of Liability

To the maximum extent permitted by law, Clearly Education shall not be liable for:

Indirect, incidental, special, or consequential damages.
Loss of profits, revenue, data, or business opportunities.
Educational outcomes or learner performance.
Decisions made based on AI-generated content.

Clearly Education’s total liability arising from the use of the Services shall not exceed the amount paid by the user during the twelve (12) months preceding the claim.

11. Third-Party Services

Clearly Education uses third-party providers, including but not limited to:

Stripe
OpenAI
WordPress plugins and hosting providers

Clearly Education is not responsible for interruptions or failures caused by third-party services.

12. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be published on this page with a revised “Last Updated” date.

Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Western Australia, Australia.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
